* Since the Constitution of the United States cannot be changed, only amended, the 18th amendment still establishes the prohibition of alcohol (repealed by the 21st amendment). In theory an amendment can be declared to have never passed (claimed of the 16th amendment by a small number) or be deemed unconstitutional (The 17th Amendment is argued to deprive states of equal representation in the Senate, the one thing an amendment can't do.
