Copyright law in the USA in the mid-20th century has always been a bit of an odd bird - normally, one has to check whether an image fell out of copyright or the copyright was renewed, and if the artist is dead, how long ago did she or he die. But in this case, we have a clue: Superman is in the image, and DC Comics has historically been pretty good about keeping their copyrights. I'd mark this as Fair Use.
