As these referenda are often written by non-politicians, or people with little formal legal training, they may ultimately prove to be of dubious constitutionality when enacted into law, and parts or all of them are often struck down by the courts after their passage. Proposition 187, a 1994 initiative in California that sought to deny certain entitlements and legal protections to illegal immigrants, was eventually struck down by the courts, and the recently-passed Proposition 8 (which reversed the state Supreme Court's legalization of gay marriage) may be headed to a similar fate.
One common problem might be the definition of state. "A" state can mean,"a sovereign polity holding territory, keeping order, and holding a monopoly on public force(or something similar). "The" state is an abstract for, [[The Government]] whomever that might be. A US State has a meaning particular to the US. A European might think of it like a province only it has in theory considerable independence and one was a sovereign state that had a notable part in history [[Everythings Big in Texas|which it will never forget to remind people of.]] A Swiss Canton is a good parallel. Arguably the reason the word was chosen was that "Colony" would no longer do.
